The League has issued a statement welcoming the decision of the Commercial Court number 10 of Barcelona, which rejected the blaugrana Dani Olmo’s registration request via precautionary measure until June 30, 2025.
After Monday’s hearing, the judge ruled today and went against Barça, which hoped to receive approval to register the Spaniard through a precautionary measure as he already did with Gavi back in 2023.
As for LaLiga, they have issued a statement supporting the decision as they believe. “none of the necessary conditions for the adoption of the precautionary measure are met.”
Recapitulating the conclusions of Judge Ignacio Fernández de Senespléda’s ruling, La Liga stated:
“The ruling defends the full legality of the decision to deny the registration of a player based on the application of article 77 of the La Liga Budgeting Standard (NEP), according to which, in the event of a long-term injury, Clubs may replace one player with another.
“The League has made a motivated interpretation of article 77 of the NEP. More importantly, it is the same interpretation that has been applied to all other teams in the competition. It is even the same interpretation that was applied to FC Barcelona in July 2024 in the cases of Araujo and Íñigo Martínez.”
The ruling also emphasized that: “The objective of authorizing excess spending is to guarantee that a long-term injury does not reduce the competitiveness of the team, not to allow long-term injuries to facilitate the registration of players whose salaries exceed the limit, as FC Barcelona intends. do.”
Furthermore, LaLiga recalled that, as the ruling itself recognizes, the decision not to register Olmo had already been taken by LaLiga’s Budget Validation Body.
In addition, it was subsequently confirmed on three occasions: by the Economic Control Committee and the Social Resources Committee of La Liga, as well as by the Second Instance UEFA Licensing Committee of the RFEF.
For all these reasons, “The League celebrates that, in the face of requests for precautionary measures of this nature, the application of a provision of the NEP that has been applied uniformly to all clubs has not been excluded, thus avoiding a serious alteration of the competitive balance of the rules. .”
